Draft Smoke-free Policy

The Council recognises the need to protect the health of the community and to increase the comfort and enjoyment of all citizens using public spaces and public facilities, which will be supported through the introduction of smoke-free areas and events within the City of Norwood Payneham & St Peters.

Background

The Council is committed to providing environments and events that are conducive to good health outcomes for the community, which may also have the added benefit of reducing littering. This will be achieved through the introduction of smoke-free areas and events within our City, which were identified in the 2015 Options for Introducing Smoke-free Areas and Events Position Paper. The Council has been progressing these initiatives since that time.

Community expectations have been changing in recent years which has led to increased calls to implement smoking restrictions in community spaces, such parks and reserves. Through the introduction of additional smoke-free areas, the Council will be helping to provide healthy public spaces, facilities and events for the community to enjoy.

The Council is seeking your feedback on the draft Smoke-free Policy, which will introduce smoking restrictions in the following locations:

  1. All Council-owned reserves and parks (including Norwood Oval and Payneham Oval, but excluding the Memorial Gardens located on The Parade, Norwood and adjacent to the Norwood Oval);
  2. The Norwood Swimming Centre and the Payneham Memorial Swimming Centre; and
  3. At all Council events, including those which are organised by the Council and those which are supported by the Council through a partnership or similar arrangement, within the defined boundary of the event.

The Memorial Garden has been excluded from the draft Policy as it will be considered separately by the Council as part of the review of the smoking restrictions on The Parade.  

In addition, signage will be erected at the above-mentioned locations to indicate to the community that smoking is restricted in these areas.

Who will be affected by the Policy

In relation to reserves, parks and swimming centres, this Policy applies to both public use and private hire of the land, and all sporting clubs which utilise these facilities. In essence, this would apply to anyone using or visiting these facilities.

In relation to Council-run and supported events, this would apply to events organised by the Council, and private events that have been formally endorsed by the Council, which could be through financial or in-kind support, and which have the Council’s logo displayed through the promotional material.

Additionally, this Policy can be enforced by the Council in any leases, licences, permits or other estates that apply to Council-owned and managed land and property.

 

How will the Policy be enforced

The Council has opted to take an educative and informational approach to smoking restrictions within the Council area and does not intend to enforce this Policy through expiation notices. Should a lessee, licensee or permit holder breach this Policy, the Council will investigate the issue and could choose to revoke the lease, licence or permit. Breaches of the Policy will be reviewed by the Council on a case-by-case basis.

 

How will people be made aware of the Policy

Should the Policy be adopted, the Council will install signage at all of the affected reserves, parks and swimming centres, which will inform the public that this is a smoke-free area and kindly ask them to not smoke in this location. Signs will also be displayed at the entrances of the boundaries of all Council-run and supported event areas. Information will also be available at the Council’s website and the Smoke-free Policy will be provided with all leases, licences, permits or other estates, where relevant.
